Access to Records
The employer should ensure that all records required to be maintained by section 5218 be made available upon request to the chief administrative officer of the California Division of Occupational Safety and Health and the director of NIOSH for examination and copying.
In addition, employee exposure monitoring records and employee medical records required for medical surveillance may be requested. They should be provided upon request for examination and copying to employees, employee representatives, and the chief administrative officer of the California Division of Occupational Safety and Health.
If the employer ceases to do business and there is no successor employer to receive and retain the records for the required period, the employer should notify the director of the National Institute for Occupational Safety and Health, U.S. Department of Health and Human Services at least three months prior to disposal. If requested within that period, the employer should transmit the records to the director.
