Employee Exposure & Medical Records
Under 8 CCR 5207 and 8 CCR 1532, employees with possible exposure to toxic substances have the right to access exposure records. After an examination, the employee must be provided copies of the following:
- The physician's written opinion including a diagnosis, physician risk assessment, recommendations for removal or limitations of duties, and a written statement saying that the physician has explained fully and clearly the results of all testing
- Results of biological tests
- Explanation of test results
The physician is not allowed to give employers any medical information about the employee that does not relate to cadmium exposure. All employee medical records and employee exposure records must be retained for at least the duration of the employee's employment plus 30 years.
Medical surveillance records must contain the following:
- The employee name, Social Security number, and description of duties
- A copy of the physician's written opinion and an explanation of the results of biological monitoring
- A copy of the medical history and any and all test results that are related to cadmium exposure
- The employee's medical symptoms that might be related to cadmium exposure
- A copy of the information provided to the examining physician
