Harassment Complaint Procedures
Even with proper training, it is possible that harassment may occur at your workplace. These incidents can lead to years-long court cases with trials that must take into account state and federal laws. (You have already seen how these laws overlap and can cause confusion.)
In this section, you will learn about your responsibilities related to sexual harassment. This includes the accepted complaint and filing procedures you and your employees must take should an incident occur.
Regardless of where and how each case ends, all sexual harassment incidents should begin with the proper complaint procedures. This is called "due process." California regulations do not define this term, but in general, it is considered to be the following:
- Informing parties what is being alleged
- Providing parties an opportunity to respond to allegations
- Being thorough and complete in the investigation process that is fair, unbiased, and timely
- Properly documenting the investigation
