Sexual Harassment Liability

Both employers and supervisors can be held liable for certain cases of sexual harassment. The courts decide who is at fault.

In this course you will also learn about the requirements for written prevention plans and the creation and implementation of workplace anti-harassment policies.

Take note: Employees cannot simply sue employers for their failure to prevent harassment. The employee must also have a claim of discrimination, harassment, or retaliation. Regardless, any complaint could lead to a DFEH investigation, and this investigation could lead to the DFEH determining that the employer violated another law, such as failing to provide a clear harassment prevention policy.
