Responsibilities Related to Complaints
Once your company receives a complaint, California law requires employers to do the following:
- Respond to complaints in a timely manner
- Conduct an investigation in a timely manner, tracking progress throughout the investigation
- Document the investigation and its progress
- Timely conclude the investigation
- Come to fair conclusions using the evidence gathered during the investigation
- Take corrective action and remedial measures (if the investigation leads to the conclusion that misconduct occurred)
- Take steps to prevent future harassment
- Develop measures that will assuage the effects of the harassing behavior
- Take steps to prevent retaliation
