Exceptions to Worker Notification

Oral warnings do not have to be given to the following workers on a farm, forest, or nursery:

  • Those who will not be in the treated area, or walk within one quarter mile of the treated area, during the pesticide application or while the restricted-entry interval is in effect
  • Those who will not be in the greenhouse during a pesticide application or while a restricted-entry interval is in effect
  • Those who applied or supervised the application of the pesticide and are already aware of all of the information included in the oral warning

Similarly, posting signs marking a treated area is not required if any of the following conditions are true:

  • No workers on a farm, forest, or nursery will be in the treated area, or walk within one quarter mile of the treated area, during the pesticide application or while the restricted-entry interval is in effect.
  • No workers will be in the greenhouse during a pesticide application or while a restricted-entry interval is in effect.
  • The only workers for whom notification is needed are the ones who will be applying the pesticide, or supervising the application of the pesticide, and are already aware of all of the information included in the oral warning.
