The Term "RCRA" & the RCRA Subtitles

In general, the term "RCRA" comprises the waste management programs managed and enforced by the EPA. However, RCRA is used in different contexts with different, but related, meanings, as follows:

  • The Resource Conservation and Recovery Act, which is the law passed by Congress
  • The regulations developed by the EPA, found in Title 40 CFR Parts 239 through 282
  • EPA guidance and policy documents related to the RCRA law and regulations

Recognizing the complexity of the RCRA regulations, the EPA provides guidance and policy documents designed to help handlers of hazardous waste comply with the regulations, and to help EPA staff members implement the regulations. The guidance documents provide the "how to" guides for implementation and compliance with the regulations. In contrast, the policy documents specify the operating procedures that should be followed.
