Closure Requirements for a Facility with a Conditional Exemption
When a facility that handles LLMW closes its business, it must address the closure requirements as mandated by RCRA regulations.
The closure requirements apply to storage facilities, or portions of facilities, that meet either of the following conditions:
- Prior to the effective date of 40 CFR 266, Subpart N (May 16, 2001), the facility stored LLMW and non-mixed hazardous waste.
- After the effective date of 40 CFR 266, Subpart N, the facility stored both LLMW and non-mixed hazardous waste.
