Eligibility & Conditions for a Conditional Exemption

Facilities must meet certain conditions to qualify and maintain a conditional exemption for the storage and treatment of LLMW. Owners and operators of the facilities are required to do the following:

• Notify the EPA director that the facility is claiming a conditional exemption for LLMW stored at the facility.
• Store LLMW in tanks or containers in compliance with the facility's license and with the chemical compatibility requirements per the RCRA regulations.
• Certify that facility personnel who manage LLMW are trained in chemical waste management and hazardous materials incidents response.
• Conduct an inventory of stored LLMW at least annually, and inspect it at least quarterly.
• Maintain an accurate emergency plan, and provide the plan to all local authorities who may be called to respond to an emergency involving the waste.
