Failure to Meet the Conditions

Failing to meet any of the conditions required for a conditional exemption for storage and treatment of LLMW will cause a facility to lose the exemption. Once this exemption is lost, the facility must do the following:

• Manage the LLMW as RCRA hazardous waste.
• Comply with the RCRA requirements for hazardous waste containers and tanks.
• Report the failure to meet the conditions of the exemption to the NRC, or the NRC Agreement State agency, within 30 days of the failure.

If the failure to meet the conditions of the exemption endangers human health or the environment, the facility must report the failure to the EPA director within 24 hours of the failure, and then follow up with a written notification within five days.
