Notification Requirements for the Conditional Exemption
Facilities that have a conditional exemption for eligible waste must make the following notifications:
- A one-time notice to the EPA director that claims the transportation and disposal conditional exemption. This notice must be made prior to the initial shipment of an exempted waste from the facility to a low-level radioactive waste disposal facility.
- A notice to the low-level radioactive waste disposal facility that is to receive the exempted waste that includes certain information (refer to 40 CFR 266.345). This notice must be made before each shipment of exempted waste, and a return receipt of the notice must be received before the shipment can begin.
