Wastes Exempted from LDR Rules
Certain wastes are exempted from the LDR program rules, as follows:
- Wastes that are generated by SQGs who produce less than one kilogram of acute hazardous waste per month
- Pesticides that are disposed of by farmers on their own land
- Wastes that have been identified as hazardous, but for which no EPA or LDR program standards have been developed
- Wastes that are released in low levels, usually as losses during normal handling or as a part of a facility's wastewater outflow
The LDR program rules do not apply when universal waste handlers and transporters are dealing with certain exempted items, including batteries, pesticides, mercury-containing equipment, and lamps.
Note, however, that in most cases, universal waste handlers and transporters must handle all other restricted hazardous wastes in accordance with the LDR program rules set forth in 40 CFR 268.
