Compliance for Used Oil Burners

To comply with the RCRA regulations, the owners and operators of used oil burners must do the following:

  • Get an EPA ID.
  • Check that the used oil is not hazardous under the 1,000 parts per million halogen standard of the rebuttable presumption.
  • Use tanks or containers to store used oil, and maintain these carefully.
  • Use secondary containment that is impervious to used oil.
  • Label containers, tanks, and related pipes with the words "Used Oil."
  • Immediately contain and clean up spills, and make repairs to prevent further spills.
  • Give each source (that is, the generator, transporter, processor, or re-refiner) of the used oil a signed certification that the oil will be burned in an industrial furnace or boiler.
  • Record all shipments of used oil that have been accepted for burning. Keep these records for three years.
