Criteria for Used Oil Transporters
Used oil transporters are people who do one or both of the following:
- Transport used oil in quantities greater than 55 gallons
- Collect used oil from more than one generator and transport this oil
The RCRA regulations for used oil transporters do not apply to the following types of used oil:
- Used oil that is transported on-site
- Used oil that is transported in volumes totaling 55 gallons or less from the place where it was generated to a used oil collection center
- Used oil that is transported by a generator that transports amounts totaling 55 gallons or less to a used oil aggregation point that is owned and operated by the same generator
- Used oil that is transported by a household do-it-yourselfer to one of the following regulated used oil entities:
- Generator
- Collection center
- Aggregation point
- Processor or refiner
- Burner
Transporters must consider other factors when they determine how the used oil that they transport is regulated. For more information, refer to 40 CFR 279.40.
