The Biennial Report
On March 1 of an even-numbered year, certain generators are required to submit a Biennial Report to the EPA regional administrator. The Biennial Report includes information about each generated hazardous waste, the activity by which the wastes were generated, and the waste quantity, as well as the management method by which each waste is treated, recycled, or disposed, and the quantity managed.
Any generator who is categorized as an LQG for at least one month of an odd-numbered year (reporting year) and who treats, stores, or disposes of hazardous waste on-site or ships any hazardous waste off-site to a treatment, storage, or disposal facility within the United States must complete the Biennial Report. LQGs must report all of the hazardous waste they generate for the entire reporting year, not just the month(s) the generator was an LQG. The LQG must use EPA Form 8700-13 A/B for the report. It is due to be submitted to the EPA regional administrator on March 1 of even-numbered years covering generator activities during the previous year.
States may have more frequent or additional data reporting requirements over and above what is required by the EPA. The states may use a different form to collect federal data and satisfy the data reporting needs of their own programs.
The Biennial Report is not used for reporting hazardous waste that is exported to foreign countries. Instead, RCRA regulations require a separate annual report in accordance with 40 CFR 262.83.
