Large Quantity Generator Closure Requirements
Prior to the new RCRA ruling, an LQG was not required to notify the EPA or most states when the generator closed its facilities. Without such information, federal and state agencies could not confirm whether or not the generator complied with specified closure performance standards. LQGs that are accumulating hazardous wastes must now meet conditions set forth in 40 CFR 262.17 prior to closing the facility or any units at the facility.
For closure of a waste accumulation unit, the LQG must do one of the following:
- Include a notice in the operating record within 30 days after closure, identifying the location of the unit
- Meet the closure performance standards found at 40 CFR 262.17 and notify EPA within 90 days of closure that the facility has closed the unit
Closure performance standards include:
- Measures to control, minimize, or eliminate the post-closure escape of hazardous materials to the ground or surface waters or to the atmosphere
- The removal or decontamination of all contaminated materials
- Proper management of hazardous waste generated during closure
- Processes for post-closure care
To properly notify EPA about the closure of a facility, an LQG must submit EPA Form 8700-12 no later than 30 days prior to closing the facility and also notify EPA within 90 days after closing the facility that it has complied with the closure performance standards. An LQG may request additional time to clean close, but it must notify EPA using EPA Form 8700-12 to request an extension.
