Alignment with DOT Regulations
When developing the RCRA regulations, the EPA avoided creating a confusing set of overlapping rules governing the transportation of hazardous wastes. Instead, the EPA chose to adopt the hazardous material transportation regulations put forth by the U.S. DOT. The applicable DOT regulations relate to the requirements for labeling, marking, placarding, using proper containers, and the reporting of leaks and discharges. Transporters of hazardous waste will be in compliance when they meet all applicable rules in 49 CFR 171 through 179 and 40 CFR 262 and 263.
The only carriers exempted from these rules are those that transport bulk shipments of hazardous waste by water. Although many of the RCRA regulations for the transport of hazardous material stem from the DOT regulations, the EPA is the authority that enforces them.
