Exceptions to the RCRA Regulations
There are some exceptions to the RCRA regulations for the disposal of hazardous waste, as follows:
- The disposal of hazardous waste in the ocean
- The disposal of hazardous waste by underground (or "deep-well") injection
- The disposal of non-contained liquid hazardous waste in any landfill
- Remediation waste management sites
Note that the RCRA rules do, however, apply to the treatment and storage of hazardous wastes before they are disposed of by being dumped in the ocean or injected into the ground.
Remediation waste management sites are not subject to some of the regulations that standard operating TSDFs must comply with. However, remediation waste management sites must obtain an EPA identification number and perform a chemical and physical analysis of a sample of the wastes that will be managed at the site. These sites are also subject to other rules that are designed to protect people and livestock, and to prevent the accidental ignition or reaction of wastes.
