Solid Waste Management Units
Subpart F of 40 CFR 264 focuses on solid waste management units. These units may be surface impoundments, waste piles, a land treatment unit, or a landfill that receives hazardous waste. Solid waste management units such as these are referred to as "regulated units." A primary concern when using regulated units is the possibility of toxic releases to the groundwater or well-water supply.
An owner or operator may be exempt from certain rules that apply to solid waste management facilities if their situation protects the water supply. For example, owners or operators may be exempt if their facility is an engineered structure; if the facility is designed and operated to exclude liquids, precipitation, and liquid run-off; or if the facility has a leak detection system built into each containment layer.
