Storage, Treatment, & Disposal of Solid Waste Military Munitions
Special RCRA criteria cover the storage of solid waste military munitions (refer to 40 CFR 266.205 through 206). As when solid waste military munitions are transported, if the munitions to be stored, treated, or disposed of exhibit a hazardous waste characteristic, or if they are listed as hazardous waste under 40 CFR 261, the munitions must be identified as hazardous waste. When a military munition is identified as hazardous waste under 40 CFR 261, it is subject to regulation under 40 CFR 260 through 270, unless certain conditions are met.
The owner or operator of a storage facility that stores waste military munitions that are exempt from RCRA regulations must provide notice to the EPA director in specific situations, including when storage begins, when any loss or theft of the waste military munitions occurs, and if any failures to meet RCRA conditions result in endangerment to human health or the environment.
