Standards for Combustion - Permitted Facilities

The owners and operators of permitted facilities are required to do the following:

  • Provide a hazardous waste analysis that quantifies the concentration of hazardous chemicals in the material to be burned
  • Comply with emissions standards (refer to 40 CFR 266.105 through 266.107)
  • Limit the burning of hazardous waste to only those wastes specified in the facility's permit
  • Perform all burning under the operating conditions specified in 40 CFR 266.102(e)

If owners or operators want to burn a hazardous waste that is not specified in their permit, they must wait to burn this waste until they have obtained a new permit, or a permit modification. At all times, all boiler and industrial furnace (BIF) units used to burn hazardous waste must be operated within the requirements stated in the permit.

The regulations for BIFs include strict requirements to ensure compliance with organic emissions standards. Operating conditions must be in compliance with the "destruction and removal efficiency" (DRE) performance standard. Specific regulations govern each type of hazardous waste and the trial burns used to analyze the chemical components of the hazardous waste.
