Closure Requirements

When a facility that handles LLMW closes its business, it must address the closure requirements as mandated by RCRA regulations.

The closure requirements apply to storage facilities, or portions of facilities, that meet either of the following conditions:

• Prior to the effective date of 40 CFR, Subpart N (May 16, 2001), the facility stored LLMW and non-mixed hazardous waste.
• After the effective date of 40 CFR, Subpart N, the facility stored both LLMW and non-mixed hazardous waste.

Exceptions to the Closure Requirements: The closure requirements do not apply to interim status units and permitted storage units that meet the following conditions:

• Prior to the effective date of 40 CFR 266, Subpart N (May 16, 2001), the facility stored only LLMW.
• After the effective date of 40 CFR 266, Subpart N, the facility has stored only LLMW that was exempt under Subpart N.
