Maintaining the Conditional Exemption for Transportation
To be eligible for the conditional exemption for transportation and disposal, waste must be either of the following:
- LLMW that meets the waste-acceptance criteria of a low-level radioactive waste disposal facility (LLRWDF)
- An eligible NARM
To maintain eligibility for the conditional exemption for transportation and disposal, the exempted waste must meet the following criteria:
- Meet, or be treated so that it meets, Land Disposal Restriction (LDR) treatment standards (refer to 40 CFR 268, Subpart D)
- Be accompanied by a proper manifest and transported according to NRC regulations (refer to 40 CFR 266.325)
- Be placed in containers when it is disposed of in the low-level radioactive waste disposal facility; permitted containers must be one the following:
- A carbon steel drum
- An alternative container that matches the performance of a carbon steel drum in the disposal environment
- A high integrity container as defined by NRC
- Be disposed of at a low-level radioactive waste disposal facility that is regulated and licensed by the NRC or an NRC Agreement State
