Notifications Requirements
Facilities that have a conditional exemption for eligible waste must make the following notification requirements (refer to 40 CFR 266.345):
- A one-time notice to the EPA director that claims the transportation and disposal conditional exemption. This notice must be made prior to the initial shipment of an exempted waste from the facility to a low-level radioactive waste disposal facility.
- A notice to the low-level radioactive waste disposal facility that is to receive the exempted waste. This notice must be made before each shipment of exempted waste. A return receipt of the notice must be received before shipment can begin. This notice must include the following information:
- A statement that claims the conditional exemption for waste.
- A statement that the eligible waste meets applicable LDR treatment standards.
- The facility's name, address, and EPA identification number.
- The RCRA hazardous waste codes that pertained to the waste prior to its conditional exemption.
- A statement that the exempted waste must be placed in containers according to the requirements in 40 CFR 266.340, in order for the waste to remain exempt under the transportation and disposal conditional exemption.
- The number for the manifest that will accompany the shipment containing the exempted waste.
- A certification that all of the information is true, complete, and accurate. This certification must be signed by an authorized representative of the facility.
