Recordkeeping for the Conditional Exemption for Transportation

Owners and operators who claim the conditional exemption for the transportation and disposal for eligible waste must follow strict recordkeeping guidelines (refer to 40 CFR 266.350). Owners and operators are required to keep the following two types of records:

  • Records required by the facility's NRC license or NRC Agreement State license
  • Records required by the RCRA regulations (refer to 40 CFR 266.350)

The records should include the following information:

  • All RCRA-mandated notification records and return receipts as required by 40 CFR 266.355, 266.360(a), and 266.345(b) (these records must be kept for three years after the exempted waste is sent for disposal)
  • All NRC-mandated documents related to tracking the exempted waste, as required by 10 CFR 20.2006 or by equivalent regulations of the NRC Agreement State
