Labeling & Marking for Recalled Versus Unused Pesticides
The labeling requirements for universal waste pesticides vary depending on whether the pesticide is being recalled, or the pesticide is considered unused universal pesticide waste. The labeling requirements are as follows:
- Recalled universal waste pesticides must include the original label that came with the product when it was sold or distributed (for example, the original manufacturer's label or other state-approved label).
- Unused universal waste pesticides must include the label that was on the product when it was purchased, if it is still legible. If the label is not legible, a replacement label should be used in accordance with the DOT regulation 49 CFR 172. If neither of these options are feasible, a replacement label should be used that is prescribed by a state-recognized waste pesticide collection program.
