EPA Rebuttable Presumption for Used Oil
Under RCRA regulations, used oil mixed with hazardous wastes must be managed as a hazardous waste. However, it is challenging for the EPA to enforce this regulation because it can be difficult to determine if a used oil contains a hazardous waste. Because of this difficulty, the EPA presumes that used oil mixtures are hazardous based on the level of total amount of halogens they contain. Examples of halogens include the following:
- Fluoride
- Chlorine
- Bromine
- Iodine
- Astatine
