Requirements for Used Oil Transporters & Transfer Facilities

To comply with the RCRA regulations for transporting and storing used oil, used oil transporters must do all of the following:

• Get an EPA identification number, if they do not already have one (refer to 40 CFR 279.42)
• Check that the used oil that is transported or stored is under the 1,000 parts per million halogen standard of the rebuttable presumption (if the halogen level is over 1,000 parts per million, the used oil must be handled as hazardous waste)
• Deliver the used oil that they receive to one of the following:
  • Another used oil transporter who has an EPA identification number
  • A used oil processing or re-refining facility that has an EPA identification number
  • An off-specification used oil burner facility that has obtained an EPA identification number
  • An off-specification used oil burner facility
• Comply with Department of Transportation (DOT) regulations in 49 CFR parts 171 through 180

To comply with the RCRA regulations for transporting and storing used oil, used oil transporters must do all of the following:

• Take immediate action to protect human health and the environment in the event of spillage or leakage of used oil during transportation (refer to 40 CFR 279.43 [c])
• Keep records of each used oil shipment that is categorized as follows:
  • Accepted for transport
  • Delivered to another used oil transporter, used oil burner, processor or re-refiner, or disposal facility
  • Exported to a foreign country
• Keep the shipment records for at least three years
• Manage residues from the storage or transport of used oil as specified in 40 CFR 279.10(e)
• Empty trucks before using them to transport used oil as specified in 40 CFR 261.7, if the trucks previously have been used to transport hazardous waste (if the trucks are not emptied as described, the used oil must be treated as a hazardous waste mixture and managed as hazardous waste)
