Standards for Used Oil Fuel Marketers

When used oil meets all the specification standards established by the EPA, it is considered to be "on-specification used oil." It is not subject to the regulations imposed on off-specification oil, which is oil that does not meet all of the standards. Once it is determined that a used oil is on-specification and after certain recordkeeping requirements are met, this used oil is not subject to used oil management standards.

Off-specification used oil is sold for use as fuel in industrial furnaces and boilers. Used oil fuel marketers are people who do the following:

  • Direct a shipment of off-specification used oil from their facility to a used oil burner
  • Make the claim that the used oil that is to be burned for energy recovery is off-specification

A used oil fuel marketer must already be a used oil generator, transporter, processor, re-refiner, or burner.

To ensure their compliance with RCRA regulations, used oil fuel marketers must do the following:

  • Get an EPA identification number
  • Only send off-specification used oil fuel to industrial furnaces or boilers that have EPA identification numbers
  • Keep records of all shipment of off-specification used oil fuels
