Designating a Facility on the Manifest
On the manifest, the generator must specify the following:
- One designated facility that is permitted to handle the waste that is described on the manifest
- An alternate facility that is permitted to handle the materials in case the designated facility becomes unable to do so
If either of these facilities are unable to receive the hazardous waste, the generator must then do one of the following:
- Designate another facility to handle the waste that is described on the manifest
- Instruct the transporter to return the waste to the generator
The following are exceptions to the foregoing requirements:
- Generators that produce between 100 kilograms and 1,000 kilograms of hazardous waste in a calendar month. For the specific rules regarding this exception, refer to 40 CFR 262.20.
- Generators that transport hazardous waste on property that they own, or for which they have a public or private right-of-way. For the specific rules regarding this exception, refer to 40 CFR 262.20.
