The Exception Report
A generator must submit an Exception Report when the generator does not receive a copy of the signed manifest back from a transporter within a specified time. The generator must take specific actions when this happens.
The Exception Report must be submitted on EPA Form 8700-13A. It is submitted to the EPA regional administrator for the region in which the generator is located. The Exception Report must include the following information:
- A legible copy of the manifest for which the generator lacks confirmation of delivery
- A cover letter signed by the generator that explains the efforts made to locate the hazardous waste and the results of those efforts
When a shipment of hazardous waste or container residue is rejected by a designated facility and needs to be transported to an alternate facility, the generator is required to create a new manifest. This new manifest is subject to the guidelines outlined in the preceding table. The generator must confirm that the new manifest has the handwritten signature of the owner or operator of the alternate facility - not the signature of the designated facility. The 35/45/60-day time frames begin the date that the rejected shipment is accepted by the transporter who will be transporting the shipment from the designated facility to the alternate facility.
