Hazardous Waste Determination

Any company that generates solid waste must determine whether that waste is hazardous. To summarize our discussion in the unit about hazardous waste classification, there are four questions to ask in the following order:

  1. Is the waste material a solid waste?
  2. Is the waste material excluded?
  3. Is the waste material a listed waste?
  4. Does the waste material exhibit a characteristic (corrosivity, ignitability, toxicity, or reactivity)?

If a generator determines that its waste is hazardous, it is important to look for exclusions and restrictions that might apply to the specific type of waste involved. For more details about exclusions and restrictions, refer to 40 CFR Parts 261, 264, 265, 266, 267, 268, and 273.

When it is confirmed that the waste is hazardous, the generator must meet the applicable requirements established by the EPA.
