Recordkeeping

Keeping accurate records and submitting reports in a timely fashion are an important part of managing hazardous waste. In addition to the manifest, which we have already discussed, certain generators are required to submit a Biennial Report and an Exception Report. Generators are also required to maintain records of any test results, waste analyses, or other determinations made according to 40 CFR 262.11. A generator must retain all of these reports for a specified period of time:

  • Signed Manifest: kept for 3 years from the date the waste was accepted by the initial transporter.
  • Biennial Report: 3 years from the due date of the report.
  • Exception Report: 3 years from the due date of the report.
  • Records of any test results, waste analyses, or other determinations made according to 40 CFR 262.11: 3 years from the date the waste was last sent to on-site or off-site treatment, storage, or disposal.
