Duties Under All Permits
A number of important requirements are incorporated into an RCRA permit. These may not be specifically stated in the permit, but are still considered required actions related to being a permit holder. The full list is provided at 40 CFR 270, Subpart C. This list includes the following duties:
- All the conditions of the permit must be complied with, unless non-compliance is authorized by means of an emergency permit.
- All facilities and systems of treatment and control that aid in achieving compliance must be properly maintained.
- Any relevant information that may be requested by the EPA director to determine whether the permit is being properly complied with must be provided on a timely basis.
Other duties are also listed. In general, there is an expectation that permit holders will be committed to carrying out the responsibilities associated with hazardous waste management, and will be willing to share information about the actual circumstances of their activities.
