The Permitting Process
A specific set of procedures must be completed before the EPA will issue a permit. Components of this process include the following:
- At least one public meeting must be held before the permit application is submitted.
- A public notice must be issued when the application is filed.
- The need for an "information repository" must be established. This is a location (accessible to the public) for documents, reports, data, and information that may be in the public interest.
- The permit application must be reviewed, and a draft permit prepared.
- The public must receive notice that the draft is available for comments, and public hearings must be convened if needed.
- The permit must be finalized.
If an applicant (for example, the owner of a TSDF) cannot meet the requirements for obtaining a standard RCRA operating perming, the situation likely to require the use of one of the special forms of permits.
