Detection, Compliance, & Correction Programs
In a manner similar to that of groundwater monitoring requirements, 40 CFR 264, Subpart F, outlines the minimum responsibilities of an owner or operator required to establish detection monitoring, compliance monitoring, and corrective action programs. The EPA regional administrator sets the specifics of what must be detected, complied to, and corrected, based on the characteristics of the waste, the surrounding area, and the groundwater present. It is the owner or operator's responsibility to take action as specified by the EPA regional administrator. These specifications will include methods that must be used, physical locations of tests (or "compliance points"), concentration limits, and other details regarding the actions that must be taken. In some cases, the required actions may extend beyond the geographic boundaries of the facility. The owner or operator must comply with these, as well. If the facility determines that its program does not comply with these, the facility must file an application for a modification within 90 days.
