Required Notices

Owners and operators of treatment, storage, and disposal facility (TSDF) must submit written notices to the EPA in the following situations:

Hazardous waste from a foreign source - The owner or operator of a TSDF has arranged to receive hazardous waste from a foreign source (outside of the United States) for the first time. The owners or operators of the TSDF must notify the EPA regional administrator in writing at least four weeks before the waste will arrive at the facility.

Hazardous waste from an off-site source - The owner or operator of a TSDF has agreed to accept hazardous waste from an off-site source for which the owner or operator is not also the generator. The owners or operators of the TSDF must inform the generator of the hazardous waste, in writing, that the TSDF has the appropriate permits and the owners and operators of the TSDF agree to accept the hazardous waste that the generator is shipping. Copy of this written notification must be retained by the owner or operator as part of the operating record.

Change in ownership of a TSDF - Before a TSDF changes ownership, during its operating life (or during post-closure care for disposal facilities) the owner or operator must inform the new owner or operator, in writing, about the requirements established 40 CFR Parts 264 and 270. Even if the original owner or operator fails to inform the new owner of the requirements, the new owner is still fully obligated to comply with all applicable requirements of these regulations.
