Driver (CDL) - Motor Carrier Safety Act of 1990

The Motor Carrier Safety Act of 1990 prohibits federal agencies from using motor carriers with a 16+ passenger capacity rated unsatisfactory to transport hazardous materials in quantities requiring placarding.

The FMCSA will track motor carriers' recordable accidents, as well as safety violations found and CMVs placed out-of-service at roadside. Therefore, the quality of a motor carrier's safety performance is one of the key things that can indicate to the FMCSA that a compliance review is in order.

If a motor carrier receives a proposed unsatisfactory rating and does not improve its standards, it must cease all hazardous materials operations on the 46th day after receiving notification.
