Canada Road & Rail Transport - Direction to Remedy Non-Compliance

When an inspector directs a person to remedy non-compliance, the inspector must give the person a Notice of Direction to Remedy Non-compliance in the form provided in the TDG Regulations, Part 16, Section 4.

The inspector must sign and date the notice. The notice must also be signed and dated by one of the following persons before it is delivered to the person who is in non-compliance:

  • The Director, Compliance and Response
  • The Chief, Response Operations
  • The Chief, Enforcement, of the Transport Dangerous Goods Directorate, Department of Transport

The direction takes effect when the notice is signed and dated. However, any non-compliance with the direction must not be enforced against a person until the person has received the notice or a copy of it, or the inspector has made a reasonable attempt to deliver it.

The direction expires 12 months after the day on which it takes effect. However, an inspector may revoke the direction sooner by written notice.
