Canada Road & Rail Transport - Means of Containment
An inspector may remove to an appropriate place any dangerous goods, the means of containment being used to handle or transport them, or a standardized means of containment. They may also direct a person or company to do so.
The inspector may also choose to detain the item that is required to be removed until he or she is satisfied that the removal will be completed in a way that complies with applicable TDG Regulations.
When an inspector detains dangerous goods or a means of containment, the inspector must deliver a Detention Notice to the person who was in charge of the dangerous goods or of the means of containment at the time they are detained. This Detention Notice must be in the form provided in the TDG Regulations, Part 16, Section 3.
The inspector must sign and date the notice. The detention takes effect as soon as the notice is signed and dated by the inspector. However, any non-compliance with the detention must not be enforced against a person until the person has received the notice or a copy of it, or the inspector has made a reasonable attempt to deliver it.
The detention expires 12 months after the day on which it takes effect. However, an inspector may revoke the detention sooner by written notice.
