Canada Road & Rail Transport - Protective Direction
The Minister of Transport may direct an individual or company to cease that activity or otherwise act to reduce any danger to public safety. These individuals or companies may be engaged in importing, offering for transport, handling, or transporting dangerous goods, or in supplying or importing means of containment. When such a direction is issued, it is referred to as a "protective direction."
The Minister of Transport cannot issue a protective direction unless it is required to deal with an emergency that involves danger to public safety but cannot be effectively dealt with otherwise.
A protective direction expires on the date specified in it. If no expiry date is specified in the protective direction, it expires 12 months after the date on which it was signed. A person may request a review of a protective direction at any time after it is signed, and the Minister of Transport can suspend or revoke the direction if he or she is satisfied that it is no longer needed.
