Canada Road & Rail Transport - Review of Detention or Direction

If the dangerous goods originate from outside Canada and the inspector believes that measures to remedy the non-compliance are not possible or desirable, the inspector may direct that the dangerous goods not be brought into Canada. If the dangerous goods are already in Canada, the inspector can order that they be returned to their place of origin. Under these circumstances, the inspector must give the person in charge of the dangerous goods a Notice of Direction Not to Import or to Return to Place of Origin in the form provided in Part 16, Section 5.

The inspector must sign and date the notice. The direction takes effect as soon as the notice is signed and dated by the inspector. However, any non-compliance with the direction must not be enforced against a person until the person has received the notice or a copy of it, or a reasonable attempt has been made to deliver it.

The direction expires 12 months after the day on which it takes effect. However, an inspector may revoke the direction sooner by written notice.
