Employees Covered - 29 CFR 1910.120
According to 29 CFR 1910.120(q)(9), titled "Medical Surveillance and Consultation," the following employees are covered under medical surveillance:
- HAZMAT team members and "hazardous materials specialists." These personnel must receive a baseline physical and undergo medical surveillance, as detailed in the standard 29 CFR 1910.120(f), titled "Medical Surveillance," and as detailed in this section.
- Emergency response employees showing "signs or symptoms which may have resulted from exposure to hazardous substances during the course of an emergency incident either immediately or subsequently." These personnel must receive a medical consultation as required in paragraph (f)(3)(ii) of this section.
29 CFR 1910.120(f)(3)(ii) states that all employees must receive treatment "as soon as possible following the emergency incident or development of signs or symptoms" (29 CFR 1910.120(f)(3)(ii)(A)) and "at additional times, if the examining physician determines that follow-up examinations or consultations are medically necessary" (1910.120(f)(3)(ii)(B). This extends to all employees who apply to one or more of the following:
- Might have been injured
- Have "received a health impairment"
- Developed signs or symptoms which could be caused by exposure to hazardous substances resulting from an emergency incident
- Exposed (during an emergency situation) to hazardous substances at concentrations above the permissible exposure limits or the published exposure levels without using the required PPE
