Physician's Written Opinion

When needed, a "physician's written opinion" must include the following:

  • The physician's opinion on if the employee has "any detected medical conditions which would place the employee at increased risk of material impairment of the employee's health" with regard to hazardous waste operations work, emergency response, or respirator use
  • The physician's recommended limitations upon the employee's assigned work
  • The results of the medical examination and tests (if requested by the employee)
  • A statement that the physician has notified the employee of the results of the medical examination and that the employee is aware of any medical conditions which require further examination or treatment

Note that the written opinion obtained by the employer must not reveal specific findings or diagnoses unrelated to occupational exposure. The employer will obtain and furnish the employee with a copy of a written opinion from the examining physician.
