Employer Responsibilities - Label Maintenance
Employers are responsible for maintaining hazardous chemical labels on the following types of containers:
- Tanks
- Totes
- Drums
Maintaining labels includes ensuring both the readability of the label and the content of the label. Labels must be legible (not defaced, faded, or washed off) and must contain information about the hazards of the chemical and its use.
Employers are not responsible for updating the labels of shipping containers. However, OSHA requires that if the employer is aware of hazards not disclosed on the label, the employer must inform workers of such hazards.
