Medical Surveillance Program - Employer Responsibility

The employer must obtain and provide the employee with a written copy of the physician's opinion regarding the following:

• If the physician has detected in the employee any medical conditions that would put the employee at an increased health risk, impairment of work in hazardous waste operations or emergency response, or impairment from respirator use
• The physician's recommended limitations (based upon the employees assigned work)
• The results of the medical examination and tests (if requested by the employee)
• A statement that the employee has been informed by the physician of the results of the medical examination and any medical conditions which require further examination or treatment

Note that the written opinion obtained by the employer "shall not reveal specific findings or diagnoses unrelated to occupational exposure."
