Responsibilities - Employers
It is the responsibility of an employer to ensure a safe working environment for all employees. OSHA law prohibits employers from retaliating against employees for exercising their rights under the law, such as raising a safety concern or reporting an injury.
An employer is responsible for ensuring the safe implementation of hot work processes. All hot work equipment is required to be kept in safe working order by employers. When a tool or piece of equipment is deemed unsafe, the equipment must be tagged as out of service and repaired by a qualified individual before its next use. Employers are responsible for ensuring that only approved tools, such as torches, regulators, and generators are used.
Employers are also responsible for ensuring that all employees involved with hot work are properly trained and familiar with safe work procedures. Employers must establish permissible areas for hot work. A hot work permit authorizing individual (PAI) must be designated by employers as well.
