Operator Certification & Licensing
While having a certificate or degree doesn't make an employee qualified, the employer must nevertheless ensure that operators have a valid certification or license from an accredited entity.
General requirements include the following:
- Certifications or licenses are of no cost to the employee.
- Certifications or licenses should be based on equipment type (or type and capacity) and this equipment must be listed on official documentation.
- Trainees should be allowed to re-apply and test again should they fail a test or lose a certification.
- Employers may also certify their employees. 29 CFR §1926.1427 details the requirements for this certification program, which involves written and practical tests, audits, and approval from another entity (someone not currently employed by this employer).
- Operators may take their test in any language. The certification or documentation must mention the language used during the test. The operator can only operate equipment that uses materials written in the language noted on the certificate.
29 CFR §1926.1427 details licensing and certification stipulations and accrediting agency requirements. Employers should consult this code to ensure that licenses and certifications meet the requirements necessary to safely and legally operate equipment.
Please note that new requirements for certification went into effect in November 2018 and early 2019. Employers must ensure that all training equipment and manuals reflect these changes and that all employees have training that meets these new standards.
