30 CFR 48 Training Rights

Miners who work at surface mines as well as at underground mines are entitled to health and safety training under 30 CFR 48. An MSHA-approved instructor must conduct the training. Miners and their representative are entitled to review the training plan at least two weeks before it is submitted to MSHA for approval. If there is no miners' representative at a mine, the operator must post the plan on a company bulletin board or hand out copies to all employees.

Miners and their representative may submit written comments concerning the plan to the MSHA district manager. The district manager will review and approve the plan or suggest changes before approval.

If a miner is away from the mine for 12 months or less, he or she must receive training concerning any major changes on-site that may affect health and safety upon his or her return to duty.

If a miner is away for longer than 12 months, he or she must receive complete retraining.
