Recordkeeping & Training Compensation
After a miner completes an MSHA-approved training program, the mine operator must record and certify on MSHA Form 5000-23 that the miner has received the specified training. In addition, the operator must do the following:
- Give a copy of the training certificate to the miner at the completion of the training
- Make training certificates for each miner available at the mine site for inspection by MSHA and examination by the miners, the miners' representative, and state inspection agencies
- Keep copies of training certificates for currently employed miners at the mine site for two years or for 60 days after a miner's employment has been terminated
- Conduct the training during normal working hours, and compensate miners who attend the training at the same rate of pay they would receive during normal working hours
- Compensate miners for any additional costs, such as mileage, meals, and lodging, if the training is given at a location other than the normal place of work
In the case of a miner leaving the employ of an operator, the miner is entitled to a copy of his or her training certificates. Under no circumstances should certification be falsified. False certification that training was given is punishable under the Mine Act.
